Changes to Maryland Housing Law
There are some big changes coming to Maryland housing law. Here’s what you need to know, as these laws go into effect October 1, 2026.
Fair Chance Housing Act
Limits the use of background checks when someone applies for rental housing. It would ensure that Maryland residents with arrest and conviction histories have a fair chance to secure housing. There are, of course, restrictions on the type of criminal act committed, and other conditions. Go here to read the bill.
Fair Housing and Anti-Discrimination Act
Includes language that codifies disparate impact liability in Maryland’s Fair Housing law that may affect protected classes without intent to discriminate. This law, while not perfect, is a large step towards making Maryland’s housing more fair and equitable. Go here to read the bill.
Housing Subsidies and Credit Reports
Prohibits landlords from denying housing for tenants who use an income-based housing subsidy, because of past credit issues that arose before the time the tenant received the housing subsidy. Tenants will also have the option of requesting that the landlord report positive and timely rental payments to credit reporting agencies. Go here to read the bill.
Water Submeters Allowed
Allows for individual submeters to be installed in apartments, condos, co-ops, and mobile homes, provided the contractor and/or landlord doesn’t charge more for water service than the landlord is being charged by the water utility company. Maintenance costs on the meters and related systems cannot be passed on to tenants. Landlords will be required to show documentation of previous water charges, and send bills in a timely manner.
